ERC Collective’s real estate brokerage services are provided through licensed real estate agents affiliated with eXp Realty in the states where those agents are licensed: Kansas and Missouri. A brokerage/agency relationship is formed only through a separate written agreement.
For short-sale transactions outside Kansas and Missouri, ERC Collective does not act as the listing or buyer’s agent. Instead, ERC Collective provides short-sale negotiation and processing services, working alongside a locally licensed listing agent and the buyer’s agent, who fill the brokerage roles in that state. Information on this website is general in nature and does not create an agency or client relationship.
For homeowners facing financial hardship or possible foreclosure: ERC Collective provides real estate brokerage (in KS/MO) and short-sale negotiation and processing services (nationally). We are not a loan-modification, mortgage-relief, or credit-repair company, and we do not provide legal or tax advice. We cannot guarantee that any lender will approve a short sale or that foreclosure will be prevented (see §6). We encourage you to consult an attorney and/or a HUD-approved housing counselor about your options.
For traditional (non-short-sale) buyer or seller representation in Kansas and Missouri, where our agents are licensed, ERC Collective is compensated through a standard real estate brokerage commission paid at closing.
All short-sale engagements begin with a processing and negotiation fee for ERC Collective’s services, in every state including Kansas and Missouri. This fee is earned and paid only at closing and is structured into the transaction — typically funded through some combination of a reduced payoff approved by the lender/servicer, the buyer’s offer, reductions negotiated with lien holders, and, in some cases as a last resort, a contribution from the participating agents’ commissions. In Kansas and Missouri, where ERC Collective may also serve as the listing agent, this fee may be reduced or adjusted to reflect that role.
ERC Collective does not collect any advance fee to negotiate with your lender or to stop foreclosure, and homeowners are not required to pay this fee out of pocket. Where our website or materials state that a short sale may be available “at no cost to you,” this refers to the fact that our compensation is paid at closing through the transaction structure described above, rather than charged to you upfront or out of pocket. Individual circumstances vary, certain third-party costs may still apply, and nothing here is a guarantee regarding fees, proceeds, or outcomes. Fee terms for a specific engagement are set out in a separate written service agreement.
We do not guarantee foreclosure prevention, sale price outcomes, lender approvals, investment returns, mentorship income results, business growth results, or any other real estate outcome. Real estate outcomes vary.
